Despite the potential prohibition established by the federal Controlled Substances Act, the court ruled in favor of the worker. This is an evolving legal landscape, as New Jersey joins Connecticut, New Hampshire and New Mexico in allowing reimbursement for specific workers, whereas Maine has ruled to the contrary. At this time, it is difficult to predict where this will lead locally as well as nationally, but it bears watching.
